TOS ( Terms Of Service )

1 - Acceptance of Terms

By accessing or using the Petfluence platform ("Platform"), you agree to be bound by these Terms of Service ("TOS") and any additional terms and conditions that may apply to specific features or services of the Platform. If you do not agree to these TOS, you may not use the Platform. Petfluence provides an online platform that connects pet owners ("Petfluencers") who create and share content related to their pets with pet-related brands ("Brands") for potential promotional collaborations. The Platform allows Petfluencers to showcase their pets, share their experiences, and participate in brand campaigns, while Brands can discover and collaborate with relevant Petfluencers to promote their products or services.

2 - Description of Services

The Platform offers a range of services, including but not limited to, creating and managing Petfluencer profiles, posting and sharing User Content, participating in brand campaigns, and potentially accessing additional features or services such as a shop or membership program. The Platform also provides communication tools for Petfluencers and Brands to connect, collaborate, and negotiate campaign details.
Petfluence endeavors to provide a reliable and secure Platform, but does not guarantee uninterrupted or error-free operation. The Platform may be subject to scheduled or unscheduled maintenance, upgrades, or other technical issues that may temporarily disrupt access or functionality. Petfluence also reserves the right to modify, suspend, or terminate any part of the Platform or its services, with or without notice, at its sole discretion.

3 - Eligibility

To use the Platform, you must be at least 18 years old or the legal age of majority in your jurisdiction. By using the Platform, you represent and warrant that you are eligible to use the Platform and that you have the necessary rights and authority to enter into these TOS. If you are accessing or using the Platform on behalf of a company or other legal entity, you further represent and warrant that you have the authority to bind such entity to these TOS.

4 - User Content

As a Petfluencer, you may create and share content on the Platform, including text, photos, videos, and other materials ("User Content"). You retain ownership of your User Content, but by posting or sharing User Content on the Platform, you grant Petfluence a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with the operation and promotion of the Platform. You are solely responsible for the User Content you post or share on the Platform, and you represent and warrant that you have all necessary rights, permissions, and consents to use, publish, and share your User Content on the Platform. You also agree not to post or share User Content that is illegal, harmful, offensive, or violates any applicable laws or regulations. Petfluence does not endorse or guarantee the accuracy, reliability, or appropriateness of any User Content posted on the Platform, and Petfluence reserves the right to remove or modify any User Content at its sole discretion.

5 - Brand Campaigns

As a Petfluencer, you may have the opportunity to participate in brand campaigns on the Platform, which may involve promoting products or services of Brands. If you choose to participate in a brand campaign, you agree to comply with any additional terms and conditions provided by the Brand, including but not limited to posting requirements, disclosure requirements, and compensation arrangements. Petfluence is not responsible for any disputes or issues arising from your participation in brand campaigns, and any agreements or arrangements between Petfluencers and Brands are solely between them.

6 - Prohibited Conduct

You agree to use the Platform in compliance with all applicable laws and regulations, and you agree not to engage in any prohibited conduct while using the Platform. Prohibited conduct includes, but is not limited to:
a. Violating any laws, regulations, or third-party rights, including intellectual property rights, privacy rights, and publicity rights.
b. Posting or sharing User Content that is false, misleading, defamatory, offensive, discriminatory, or otherwise inappropriate.
c. Using the Platform to promote or engage in illegal, harmful, or fraudulent activities, such as spamming, phishing, or hacking.
d. Impersonating any person or entity, or falsely claiming an affiliation with any person or entity.
e. Interfering with the operation of the Platform, including but not limited to tampering with, hacking into, or disrupting the servers or networks connected to the Platform.
f. Engaging in any activity that could harm, disable, overburden, or impair the Platform or interfere with the use of the Platform by others.
g. Using any automated means, such as bots or scripts, to access, collect, or harvest data from the Platform without Petfluence's prior written consent.
h. Circumventing, disabling, or otherwise interfering with any security features or access controls of the Platform.

7 - Intellectual Property Rights

The Platform and its content, including but not limited to text, graphics, logos, icons, images, videos, and software, are owned by Petfluence or its licensors and are protected by intellectual property laws. You may not reproduce, modify, distribute, display, or use any of the Platform's content without Petfluence's prior written consent. Petfluence respects the intellectual property rights of others and expects its users to do the same. If you believe that your intellectual property rights have been infringed on the Platform, please contact Petfluence immediately and provide the necessary information for Petfluence to investigate and take appropriate actions.

8 - Privacy

Petfluence takes the privacy and security of its users' information seriously. Petfluence's Privacy Policy, available on the Platform, explains how Petfluence collects, uses, and protects your personal information. By using the Platform, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.Privacy Policy

9 - Termination

You may terminate your use of the Platform at any time by closing your account or ceasing to use the Platform. Petfluence reserves the right to terminate or suspend your access to the Platform at any time, with or without cause, at its sole discretion. Upon termination, your right to use the Platform will cease, and any provisions of these TOS that should survive termination, including but not limited to intellectual property rights, liability disclaimers, and indemnification, will continue to apply.

10 - Disclaimers and Limitation of Liability

The Platform and its services are provided on an "as is" and "as available" basis without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. Petfluence does not warrant that the Platform will be error-free, uninterrupted, or secure, or that any defects or errors will be corrected. Petfluence does not endorse or guarantee the accuracy, reliability, or completeness of any information or content on the Platform, including but not limited to User Content and Brand campaigns. To the fullest extent permitted by applicable laws, Petfluence and its affiliates, officers, directors, employees, and agents will not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of the Platform,
